DOMA 2, The Sequel Introduced By Texas Congressman

Randy Weber, a conservative Republican congressman from Texas has proposed "The State Marriage Defense Act" (H.R. 3829), on Thursday; a measure which would strip federal marriage benefits from gay and lesbian couples living in states where same-sex marriage is illegal. The move comes as a response to the Supreme Court's decision in United States v. Windsor which struck down Section 3 of the 1996 Defense of Marriage Act (DOMA).

Hypothetically, if passed, a couple married in Massachusetts that moves to North Dakota would no longer be eligible for the protection of approximately 1,000 Federal laws and benefits that reference marriage.

A statement from Representative Weber's office released to the press reads:

"The 10th Amendment was established to protect state sovereignty and individual rights from being seized by the Federal Government. For too long, however, the Federal Government has slowly been eroding state's rights by promulgating rules and regulations through federal agencies.
I drafted the "State Marriage Defense Act of 2014" to help restore the 10th Amendment, affirm the authority of states to define and regulate marriage, as well as, provide clarity to federal agencies seeking to determine who qualifies as a spouse for the purpose of federal law. By requiring that the Federal Government defer to the laws of a person's state of legal residence in determining marital status, we can protect states' constitutionally established powers from the arbitrary overreach of unelected bureaucrats."

Tony Perkins, head of the SPLC designated hate group Family Research Council (FRC) issued the following statement Thursday:

"In recent months, we have witnessed the growing serious consequences of redefining marriage. We've seen wedding florists, bakers, photographers who have been hauled into court, fined and even ordered to violate their religious beliefs by participating in same-sex weddings. And last month, a federal judge cited same-sex marriage in his decision striking down Utah's law against polygamy. Another consequence has been the Obama administration's chaotic actions through federal agencies that demonstrate total disregard for the 33 states that have not redefined marriage."

The Miami Herald reports, "The State Marriage Defense Act" was introduced with 28 co-sponsors and is supported by Family Research Council, National Organization for Marriage, Ethics and Religious Liberty Commission, US Conference on Catholic Bishops, Concerned Women for America, and Heritage Action.
